MyNotary provides notarial and commissioning services within the authority permitted by Ontario law. Depending on the service, this may include confirming identity, witnessing a signature, administering an oath or affirmation, taking a statutory declaration, or comparing an original document with a copy for certification.

A notarization or commissioning confirms the particular act performed by the notary or commissioner. It does not generally confirm that the contents of the document are true, legally effective or suitable for your particular purpose.

Unless a separate legal service has been expressly agreed to, MyNotary does not provide legal advice, legal opinions, legal representation or substantive legal drafting through its notarial services.

We do not choose a legal document for you, advise you about its legal consequences or determine whether it protects your rights. You are responsible for providing the document you need and for confirming the requirements of the organization that will receive it.

If you are uncertain about your legal rights, obligations or the effect of a document, you should obtain independent legal advice before signing.

You may be asked to provide satisfactory government-issued identification before a notarial or commissioning service can be completed.

Please review your document before your appointment and complete any sections you are responsible for, unless you have been instructed otherwise.

If your signature must be witnessed, sworn or declared before the notary or commissioner, do not sign the document in advance.

We may decline, postpone or stop a service where we cannot satisfactorily confirm identity, where required information is missing, where the document appears incomplete or altered, where there are concerns about fraud, coercion or misuse, or where completing the requested act would be inconsistent with applicable law or professional obligations.

A decision not to proceed with a notarial or commissioning service is not a legal opinion about the document or the underlying transaction.

When we certify a true copy, we compare the copy with the original document presented to us and certify the copy where appropriate.

Certification confirms that the copy corresponds with the original that was examined. It does not independently authenticate the original document or confirm that the information contained in it is true.

The organization receiving the document determines whether it will accept a certified copy and may have its own requirements about who can certify it, the wording required or how recently it must have been certified.

Some affidavits, statutory declarations and other eligible documents may be commissioned remotely where Ontario law permits and the requirements for remote commissioning can be satisfied.

Remote commissioning is completed through real-time audio-video communication and includes identity confirmation, the administration of the oath, affirmation or declaration, appropriate signing and the required remote-commissioning wording and recordkeeping.

Remote commissioning is different from remote notarization. A service that requires an in-person notarial act or examination of an original document cannot be completed remotely through our remote commissioning service.

The organization receiving your document may have its own rules about whether remote commissioning is accepted. If acceptance is important, confirm the requirements with the receiving organization before your appointment.

MyNotary can assist with document review, required notarization where applicable, apostille submission support and return arrangements.

MyNotary does not issue apostilles or government authentication certificates. Apostilles and authentications are issued by the applicable Canadian government authority.

Requirements vary depending on the document, where it was issued or notarized, the country where it will be used and the requirements of the receiving organization.

Some documents can be submitted directly for an apostille, while others may require notarization or another step first. We can review the document and explain the administrative process, but the final decision belongs to the applicable government or receiving authority.

Submitting an appointment request does not automatically confirm an appointment. Your appointment is confirmed when you receive confirmation from MyNotary through the booking system, email, telephone or another communicated method.

We may ask for basic information about your document before the appointment so that we can confirm whether we offer the requested service and what you should bring.

Quoted fees apply to the services identified in the quote or booking information. Government, courier, translation, consular or other third-party charges may be additional where applicable.

Different courts, government authorities, banks, schools, embassies, consulates, employers and other organizations may have different document requirements.

A notarization, commissioning, certified copy or apostille-support service cannot guarantee that a particular organization will accept, approve or process a document.

Where possible, you should confirm the receiving organization's current requirements before your appointment, particularly for documents intended for use outside Canada.

Government authorities, apostille offices, consulates, couriers and other third parties operate independently from MyNotary.

Processing times, government requirements, fees, delivery times and decisions made by those organizations are outside our control and may change.

Any estimated processing or delivery time provided by MyNotary is for general planning purposes unless we expressly state otherwise.

MyNotary provides its services from Ontario and operates within the scope of the authority applicable to the notarial, commissioning and related services we provide under Ontario law.

We may provide eligible services to clients located outside Ontario, including clients elsewhere in Canada or abroad, where the requested service can properly be performed from Ontario and applicable legal, professional and document requirements permit.

A client's location outside Ontario, or the fact that a document will be used outside Ontario or outside Canada, does not by itself prevent MyNotary from providing an eligible Ontario-based notarial, commissioning or apostille-support service.

MyNotary does not represent that it is authorized to practise law, act as a notary or exercise professional authority conferred exclusively by another province, territory or foreign jurisdiction.

Services involving clients located in Quebec, documents governed by Quebec law or matters intended primarily for use in Quebec may be subject to additional restrictions because of Quebec's distinct legal system, French-language requirements and professional regulatory framework.

MyNotary does not routinely provide services to clients located in Quebec. In limited circumstances, we may consider a request where the service can lawfully and appropriately be provided from Ontario and does not require us to practise Quebec law, act as a Quebec notary or provide a service reserved to a professional authorized in Quebec.

Acceptance of any Quebec-related request is determined on a case-by-case basis. MyNotary may decline a request where there is uncertainty concerning jurisdiction, language requirements, professional authority, document validity or compliance with applicable Quebec requirements.

Clients remain responsible for confirming that the completed document, the manner in which it was executed and any related notarial, commissioning or apostille-support service will be accepted by the receiving organization or jurisdiction.

We make reasonable efforts to keep the information on this website clear and current. However, laws, government procedures, fees and document requirements can change.

Website information is general in nature and may not apply to every document or situation. Current instructions from the government authority or organization receiving your document should take priority where they differ from general website information.

Our website may link to Ontario legislation, government departments, embassies, consulates or other third-party websites for convenience.

Those websites are operated independently. MyNotary is not responsible for their availability, content, privacy practices, security or later changes to their information.

Personal information provided through the website or in connection with an appointment is handled in accordance with the MyNotary Privacy Policy.

Please provide only the information reasonably necessary for your inquiry or service and avoid sending unnecessary sensitive documents through ordinary email or unsecured communications.

You are responsible for providing accurate and complete information relevant to the requested service and for reviewing your document before signing it.

MyNotary is not responsible for consequences resulting solely from inaccurate information supplied to us, an incorrect document supplied by the client, failure to follow the receiving organization's instructions, or changes made to a document after our service has been completed.

To the extent permitted by law, MyNotary is not responsible for a third party's refusal to accept a document, government or courier delays, changes to external requirements, or decisions made by a court, government authority, consulate, bank or other receiving organization.

Nothing in this Disclaimer excludes or limits any responsibility that cannot lawfully be excluded or limited.

This Disclaimer and the use of the MyNotary website are governed by the laws of the Province of Ontario and the applicable laws of Canada.

MyNotary provides its services from Ontario. Nothing on this website represents that MyNotary is authorized to practise law, act as a notary or exercise professional authority conferred exclusively by another province, territory or foreign jurisdiction.

Eligible Ontario-based notarial, commissioning and related services may nevertheless be provided to clients located outside Ontario where permitted and appropriate.

Where a document is intended for use outside Ontario or outside Canada, the client remains responsible for determining the requirements of the receiving jurisdiction and confirming that the document and the service performed will be accepted for its intended purpose.
